A DIGEST OF RECENT OPINIONS OF ATTORNEY GENERAL

The serving of intoxicating liquor at "drive-ins" to patrons for consumption in automobiles is illegal, Attorney General Latham Castle has held in a recent opinion.

Such sales, Castle's opinion held, make the holder of a retail liquor license subject to penalties which include revocation of his license.

Other recent official opinions issued by Attorney General Castle include:

The State of Illinois is not required to fence its state forests. Further, Castle's opinion said, the State is not required to participate in sharing the costs of either the erection or maintenance of any division or partition fence;

When an adult purchases enough alcoholic drinks to supply one or more minors who are with him in a tavern and gives one drink to each such minor, both he and the minors as well as the bartender and holder of the license for the tavern can be prosecuted under the Illinois Dram Shop Act;

A new bank, even though it is legally organized to do business in Illinois, is not eligible to become a depository of state funds until "it has opened its doors for the purpose of discounting notes or receiving deposits";

Women sent to Dwight Reformatory after conviction as first offenders for possession of narcotics are guilty of misdemeanors, not felonies, and the State Parole and Pardon Board cannot consider giving them paroles. However, Castle's opinion said, such women can earn "good time" as a reward for observance of reformatory regulations.
