RULES AND REGULATIONS

BOARD OF FIRE AND POLICE COMMISSIONERS CITY OF PEORIA, ILLINOIS

Adopted: January 6, 1956

Section I. Organization

1. The BOARD OF FIRE AND POLICE COMMISSIONERS OF THE CITY OF PEORIA, ILLINOIS, hereinafter referred to as the "BOARD" shall hold a Regular Meeting, for the transaction of business on the First and Third FRIDAY of each month. The Chairman may postpone a regular meeting until a later date.

2. Two members of the BOARD shall constitute a quorum whether regular or special meeting.

3. Special Meetings may be called by any two members of the Board with written notification to the other member of the Board.

Section II. Chairman, Secretary

1. The BOARD shall annually, on the first regular meeting in May, elect a Chairman and Secretary, who shall hold their office for a term of one year, and until their successors are duly elected and qualified.

Section III. Duties

1. The Chairman shall be the presiding officer at all meetings and shall attend to all duties ordinarily pertaining to such office.

2. The Secretary's duties shall be (1) keep the minutes of the Board's proceedings as a permanent record, (2) shall be the custodian of all papers pertaining to the business of the Board, (3) shall keep a record of all examinations held, and (4) shall perform all other duties the Board prescribes.

Section IV. Motions

1. Motions or Resolutions may be made orally by any member, and shall be recorded in the minutes of the Secretary together with action taken upon same.

Section V. Business

1. The following order of business shall be followed in disposing of business before the BOARD.

1. Call to Order by Chairman.
2. Roll Call.
3. Reading and approval of minutes.
4. Receiving reports and action on same.
5. Consideration of appointments.
6. Old Business
7. New Business, etc.
8. Adjournment.

Section VI. Publication

1. These and any other rules or regulations may be suspended or amended at any time by a majority vote of the BOARD after notice by publication in a newspaper of general circulation according to law.

Section VII. Annual Report

1. Annually, or at any time the City Council may provide, the BOARD shall submit to the mayor a report of its activities, and of the rules in force and the practical effect thereof. In this report the BOARD may make suggestions which the BOARD believes would result in greater efficiency in the fire or police department.

Section VIII. Rules of Procedure in the Conduct of Hearing Upon Charges Before the Board of Fire and Police Commissioners.

1. All charges against members of the Fire or Police Department must be presented to the Board in writing by the person or persons making such charges. A violation of the Rules and Regulations of the Police and Fire Departments adopted as an amendment to the Personnel Ordinance of the City of Peoria shall constitue cause for the suspension, removal or discharge from the service of the respective Department, subject to hearing before the Board.

2. When charges are so filed, the Board, will, through its secretary, notify the accused party of the charges filed against him and shall notify the accused of the time and place of the hearing. Not less than five (5) days shall be given for the preparation of the defense.

3. In the conduct of such investigation, each member of the Board shall have power to administer oaths and affirmations, and the Board shall have power to secure by its subpoena, both the attendance and testimony of the witnesses, and the production of books and papers relevant to such investigation.

4. The person accused shall file an answer to the charges with the Secretary of the Board not less than five (5) days before date of hearing.

5. All testimonial evidence shall be under oath or affirmation and all evidence and proofs shall conform to the issues made as aforesaid. The person accused may be heard in person or by Counsel with the privilege of examination and cross examination conducted with proper decorum. The Board may call upon the Legal Department of the City of Peoria to present the evidence in support of such charges. The Board may continue such hearing for any good cause shown, provided such continuance shall not be made for a longer period than is reasonably necessary.

6. If any person against whom charges have been filed shall fail to answer the charges, or to appear at the hearing before the Board, the Board may hear such evidence as may be produced, or as it shall deem proper or necessary and make a finding according to the evidence.

7. The Board after hearing of evidence and completion of testimony in the case of the suspension of a member of the Police or Fire Department may immediately announce its decision in the case, or defer same until a date fixed by the Board; provided, however, that a decision is rendered within thirty (30) days of the date of suspension.

8. The Board shall have sole authority to determine the punishment for violations of the Rules and Regulations governing the Fire and Police Departments and shall notify in writing the accused of the results of their findings. A copy of such decision shall be filed in the history folders of the concerned parties.

9. Any officer or member of either the FIRE or POLICE DEPARTMENT, who shall have been dismissed and removed from the service by the Board, shall not be eligible to employment again in said department until the expiration of two (2) years, and then only after examination in accordance with the Rules of the Board.

10. Payment or non-payment of salary for periods of suspension pending a hearing shall be at the discretion of the Board and notice of its decision shall be forwarded by the Secretary to the City Comptroller.

Section IX. Rules Governing Original Appointments to the Police and Fire Departments

1. Applications for appointment to the Police and Fire Departments must be made in handwriting of the applicant and on appropriate

blanks furnished to the applicants by the Board of Fire and Police Commissioners and signed, sworn to, and filed with the Personnel Officer at least three days prior to the date of the examination as announced. All applications shall be in the hands of the Secretary of the Board 48 hours prior to examination.

2. Every application must be accompanied by satisfactory proof of age and a certified copy of discharge if the applicant is a veteran.

3. All applicants are subject to any investigation necessary to establish good character and reputation.

4. Applicants must have reached their 21st, but not their 35th birthday before the date of the examination.

5. Applicants must be citizens of the "United States and residents of the City of Peoria for at least one year immediately preceding the date of the examination.

6. Applicants for the Police and Fire Departments must not be less than 5 feet, 9 inches in height, with weight proportionate to height according to the following schedule:

7. At the time of examination, applicants tor Policewomen and Matrons in the Police Department must be not less than 5 fet, 4 inches in height, without shoes,

and weigh not less than 130 lbs., nor more than 180 lbs., and with weight and height proportionate to height and age, which must be between 25 to 35 years of age.

8. Applicants must also submit to fingerprinting by the Peoria Police Department before receipt of the application.

9. The examinations for patrolmen and firemen shall consist of the following two parts with the following weights:

a. Written examination 70%
b. Oral examination 30%

10. A passing grade of 60% must be received in each part of the examination. A grade below 60% in any part will result in disqualification. However, the Board, previous to any examination, may determine that the median grade on the examination shall be equal to 60% with all other grades being adjusted to that median.

11. Veterans shall receive preferance according to law.

12. All applicants approved for the eligible list for either the Police or Fire Departments will be subjected to Medical and Psychiatric examination in accordance with the minimum standards adopted, and shall furnish proof of acceptance by the examining physician of the Fire or Police Pension Boards prior to assignment to either Department. A rejection on the basis of any examination shall constitute a complete rejection of the applicant.

13. The Board shall prepare, keep and furnish to the Fire and Police Chief and to the Personnel Officer, a register of applicants passing examinations. This register is to be known as the Eligible List. Such applicants shall take rank upon the register without reference to priority of time of examination. Provided, however, that no such eligible list shall be in force for a period longer than 1 year.

14. All appointments to the Police and Fire Departments shall be for a period of six months which shall serve as a probationary period during which time the appointee's work shall be evaluated and rated monthly by his commanding officers. These ratings shall be forwarded to the Personnel Office through this Board. Prior to the completion of the probationary period the Chief of Police and Chief of Fire, with the approval of the City Manager, shall make recommendations for the dismissal or retention of the probationer.

15. The City Manager shall inform the Board in writing as to the existence of vacancies in the Police or Fire Departments and shall request in writing the filling of these vacancies. The Board, upon receipt of this written request, shall fill such vacancies from the eligible list. When such vacancy results from a resignation, the resignation must be on file with the Secretary before the vacancy is filled.

16. Pursuant to law, the Board may make temporary appointments to prevent a stoppage of public business, to meet extraordinary situations or to prevent the material impairment of the Department. Such temporary appointments shall not be made to exceed sixty (60) days.

17. The Board shall require that each Police Officer shall take the following Oath from the City Clerk of the City of Peoria:

Section X. Rules for Promotion With The Police and Fire Departments

1. Promotions in the Police and Fire Departments shall be on the basis of examination, performance ratings, and seniority.

2. Examinations for promotion shall be competitive among members of the next lower rank and shall be held for the rank only with division assignments to be made by the Chief of Police or the Chief of Fire Department, according to Chapters 10 and 12 of the Peoria Municipal Code, as amended.

3. All candidates for promotion shall be examined according to the standards as adopted in Rule IX-12. In addition, each candidate shall submit himself to an adaptability test to be established by the Board. Rejection of the candidate in any of these examinations shall result in his disqualification.

4. Applicants must file their intention to take the examination with the Secretary of the Board two days prior to the date of the examination.

5. The examination for promotion shall consist of the following parts with the following weights:

a. Written examination 50%
b. Oral examination 30%
c. Performance rating 20%

6. To the score as computed in Rule X-5 shall be added a credit for seniority not to exceed 20% of the score as computed in Rule X-5. Seniority shall be credited at the rate of 1% per year of service in the department. Any part of a year of service over six months shall be counted as a full year. Seniority for the purposes of promotional examinations shall be computed to the date of the examination.

7. In order to pass any promotional examination, it shall be necessary to receive a score of 70 in Sections A, B, C, of the examinations as shown in Rule X-5 and a total score of 70 or more.

8. Upon the completion of the examination process, the examinees shall be listed in order of their score, the highest first. This shall then become the eligible list when officially adopted by the Board and a copy shall be given to the Fire and Police Chief and to the Personnel Officer. All examinees will be notified of their grade and in addition the promotional eligible list shall be posted in appropriate public places, i.e.. Police Station, Fire Stations, etc.

9. The City Manager shall inform the Board in writing as to the existence of vacancies in any ranks of the Police or Fire Department and shall request in writing that the position be filled. The Board, upon receipt of the written request, shall fill such vacancies from the top three of the eligible list. Provided, however, that such eligible lists shall not be in effect for more than one (1) year after they are officially adopted by the Board.

Section XI. Retirement

1. The maximum age for legal employment of policemen or firemen in the service of the City of Peoria is 65 years of age. Any such policeman or fireman upon attaining the designated age of 65 years may immediately be retired from the service of the City. The Board may retire automatically any such policeman or fireman and certify such retirement or discharge to the City Manager.
