1987 HOUSE/SENATE VOTES

H.B. 552 — Lease of Park Property

Permits park districts of fewer than 500,000 inhabitants to lease property the district deems is not required for park or recreational purposes to any individual or entity, and to collect rents therefrom. It also provides that the terms of the leases may not exceed 20 years.

A yes vote represents the Associations' position.

H.B. 1538 — Motor Fuel Tax

Amends The Motor Fuel Tax Law. Specifies that the president of a park district, forest preserve district or conservation district shall act as a highway commissioner for the purpose of receiving and disbursing funds allotted pursuant to the Act. Deletes requirement that road districts levy a tax as a prerequisite to receiving Motor Fuel Tax monies. Effective immediately.

A yes vote represents Associations' position.

H.B. 803 — Expands Annexation Authority

Provides that territory separated from a park district only by a forest preserve district may be annexed by the park district. Provides that the territory of the forest preserve district shall not be annexed, and shall not be subject to rights-of-way, without the consent of the forest preserve district.

A yes vote represents the Associations' position.

H.B. 1572 — Park Drug Violations

Amends The Illinois Controlled Substances Act to provide that violations of the Act committed in or around public parks require the enhanced penalties now required for committing such offenses around schools.

A yes vote represents the Associations' position.

H.B. 868 — Liquid Asset Fund Participation

Amends various Acts regulating park and forest preserve districts. Authorizes a custodian of forest preserve district or park district funds, or a custodian of funds held by an intergovernmental risk management association or self-insurance pool composed solely of participating park districts, forest preserve districts or park district joint recreational programs, to combine monies within such funds; join with other custodians and pool such funds for investment purposes, and enter into agreements necessary for investment management.

A yes vote represents the Associations' position.

H.B. 1922 — Receipts and Disbursements Filing Extension

Amends The Custodian of Public Funds Act. Requires custodians of public monies to file a certificate of publication and a copy of the published statement or audit with the county collector, the county treasurer or the township collector within six months (now, 60 days) after the expiration of each fiscal year.

A yes vote represents the Associations' position.

H.B. 1256 — Bid Limits

Provides that in districts governed by park and forest preserve districts, contracts for expenditures in excess of $10,000 rather than $4,000 must be let through competitive bidding. It also amends an Act relating to forest preserve districts in counties of 3,000,000 or more inhabitants. Grants such forest preserve districts the right of first refusal for the purchase of any golf course in the district.

A yes vote represents the Associations' position.

H.B. 1490 — Municipal Regulation (House Only)

Amends The Illinois Municipal Code to provide that a municipal ordinance, rule or regulation shall prevail over conflicting exercises of authority by other local governmental entities.

S.B. 600 — SRA Tax Increase Amendment (House Only)

Restores provisions requiring park districts, corporate authorities or recreational boards to submit a referendum prior to levying a tax for recreational programs for the handicapped.

S.B. 600 — SRA Tax Increase Conference Committee Report

Amends The Park District Code and The Illinois Municipal Code to increase the tax rates for recreational programs for the handicapped from .02 percent to .04 percent and deletes the provision requiring park districts, corporate authorities or recreational boards to submit a referendum prior to levying such tax. Effective immediately.
