September 1994 Municipal Calendar

This calendar is based upon the most current information,
court decisions and legislation of which the League has knowledge
as of the date of this publication. If supercedes similar
information contained in all other League publications.

Return of delinquent special assessments shall be made five days prior to the date fixed for application for judgment. (65 ILCS 5/9-2-85).

Votes must be cast for trustee of the Illinois Municipal Retirement Fund. (40 ILCS 5/7-175).

All municipalities with 100 or more employees must prepare an equal employment opportunity report (Form EEO-4) documenting sex, race and salary data for all employees including part-time help. The report is to be submitted to the Equal Employment Opportunity Commission by September 30, each year. This form will be supplied by the EEOC to those municipalities required to participate.

On or before the first day of October, home rule municipalities must file with the Department of Revenue a certified copy of any ordinance or resolution imposing or discontinuing a retailer's occupation tax or effecting a change in the rate thereof. (65 ILCS 5/8-11-1).


RESOLUTION #94-R-29

A RESOLUTION TO SUPPORT A STATE-WIDE
ZERO-TOLERANCE LAW FOR DRIVERS
UNDER THE AGE OF 21 YEARS
AND
A RESOLUTION TO SUPPORT A LAW
IMPOSING A "SOCIAL HOST" LIABILITY

WHEREAS, abuse of alcohol and other drugs in this country has reached epidemic proportions, with those young people from fifteen to twenty-four years of age being most susceptible to dangers of such abuse; and

WHEREAS, in this county persons under the age of twenty-one are over-represented in alcohol-related automobile accidents and fatalities and more teenagers die from alcohol-related traffic accidents than from any other cause; and

WHEREAS, the United States Department of Transportation's National Highway Traffic Safety Administration encourages states to adopt laws designed to reduce alcohol-impaired driving by under-age drivers; and

WHEREAS, because the statewide ZERO-TOLERANCE laws for drivers under the age of twenty-one have been proven to help lessen, to a measurable extent, drinking and driving incidents, accidents and related deaths, it is imperative that such a unified Illinois prevention and deterrent law be created; and

WHEREAS, young people frequently obtain alcohol in a social setting from adults who permit or tolerate the use of alcohol by persons under twenty-one years of age on premises under their supervision and control.

NOW. THEREFORE. BE IT RESOLVED by the President and Board of Trustees of the Village of Wilmette, Cook County, Illinois;

ONE: that the Board of Trustees of the Village of Wilmette does hereby support and encourage state legislators and the Governor of the State of Illinois to adopt a state-wide ZERO-TOLERANCE law for drivers under the age of twenty-one years; it is urged that such law include automatic suspension of any such young person's driver's license until his/her case has been adjudicated and require that no license be issued to any unlicensed driver who has been found guilty of violating this blood-alcohol prohibition for a period of six months from the date such person applies for a license — thereby making a visible statement that the State of Illinois is committed to a drug-free and healthier youth population,

TWO: That the Board of Trustees of the Village of Wilmette support and encourage state legislators to adopt a law requiring persons who host private social gatherings and who furnish alcohol to persons under the age of twenty-one years at those gatherings by held financially responsible when the under-age persons cause damages as a result of the alcohol served at the social gatherings.

THREE: That the Village Clerk is directed hereby to forward a certified copy of this Resolution to the Governor of the State of Illinois, to those members of the Illinois General Assembly who are elected from the geographic area that includes the Village of Wilmette, to the Northwest Municipal Conference, and to the Illinois Municipal League.
