Bill Summaries


Use of item veto challenged
Can the governor use the item veto to strike language, rather than a dollar amount, from an appropriation bill? Gov. Dan Walker did just this with Senate Bills 1324 and 1383 and House Bills 2350 and 2355 passed in the 1974 spring session. His action was ruled ineffective by the presiding officer of the chamber to which the bill in question was returned in the fall session, so that no legislative response was held to be necessary.

The bills and provisions involved were:
— S.B. 1324 (Superintendent of Public Instruction) Establishes position titles and pay rates.
— S.B. 1383 (Department of Corrections) Prohibits expenditures for health and hospitalration insurance for inmates.
— H.B. 2350 (Department of Children and Family Services) Qualification relating to fiscal 1974 costs.
— H.B. 2355 (Department of Public Health and Comprehensive Health Planning Agency) Language restricting disbursement of item to same amount as fiscal 1974 plus possible one-third increase.

In his veto messages on these bills, the governor quoted the Constitution, "Appropriation bills shall be limited to the subject of appropriations" (Art. IV, sec. 8 (d)). He contended the vetoed language contravened this provision and that he acted to "avoid confusion and forestall the possibility of Constitutional attack" on the bills.

The rulings of House Speaker W. Robert Blair and Senate President William C. Harris cited Illinois Attorney General Opinion S-630, Oct. 11, 1973, holding such a veto by the governor invalid in the case of 1973 Senate Bill 698 involving the Hat grant rate per semester hour for state reimbursement of community colleges.
